Arbitration
Arbitration is an agreement-based alternative to the civil courts. Arbitration has to be agreed upon in one way or another. Either through a specific arbitration agreement or, alternatively, through industry agreements where you agree to follow the legal framework of a specific arbitration court (e.g. the ICC).
The main advantage of arbitration is confidentiality. Also the process is typically faster and more efficient than in civil courts. Another advantage of arbitration is that an awarded decision can easily be enforced in over 140 countries as a result of the New York Convention.
